When a lease agreement comes to an end, who is responsible for terminating it - the landlord or tenant❓

📬 Between 80 - 40 Business Days before termination, the landlord must notify the tenant, in writing:
〰️ Whether they are offering a renewal or termination on expiry, and
〰️ What the material changes are to the lease agreement if it is automatically continued on a month-to-month basis.

📬 30 Business Days before termination of the lease, the tenant must notify the landlord, in writing:
〰️ Whether they would like the lease to be terminated on expiry, or
〰️ They would like an extension of the lease through: an Addendum or a New Lease Agreement.

Which rental bracket is performing the best in terms of good standing ratio right now? Here is a quick overview for you from the latest TPN Residential Rental Monitor:

➡️ The national average of tenants in good standing is 82.34%.

➡️ The rental bracket between R7 000 and R12 000 had the highest percentage of tenants in good standing, at 88.04%.

➡️ Tenants paying between R12 000 and R25 000 were the second-best paying tenants, with a good standing rate of 87.51%.

➡️ The R3000 - R7000 rental bracket had a good standing ratio of 82.66%.

➡️ Tenants who paid less than R3 000 per month had the highest percentage of non-payment (16.39%) among all rental brackets.

We are often asked whether a landlord can cancel a lease agreement when they sell their property. The simple answer is no. The tenant is protected by the common law principle of "huur-gaat-voor-koop." If the property is sold, the new owner becomes the landlord, and all the terms of the existing lease agreement remain the same. The owner cannot cancel the lease but must wait until the end of the existing lease period. The new owner is also responsible to refund the deposit less any claim for damage.

Having said that there are two exceptions:

• If the lease agreement has a clause that allows the landlord to cancel in certain circumstances like the sale of the property
• If the property sold on auction by the Sheriff of the Court
