Your lease is fixed until March. Your landlord just sent an increase notice. Can they actually do that?

In South Africa, a landlord generally cannot increase rent during a fixed-term lease unless the lease agreement specifically includes a clause allowing for it, and that clause sets out how and when the increase applies. If your lease is silent on increases, the rent stays the same until the fixed term ends. At renewal, the landlord can propose a new rental amount, and you can negotiate or choose not to renew. Neither party can simply impose a change mid-term without the other's written agreement.

It's not about whether the market has moved. It's about what your signed lease actually allows.

Read your escalation clause before you sign. It matters more than the starting rent.

Sold this one in Bo-Dorp on a exclusive mandate!
