🏡 IMPORTANT UPDATE FOR SOUTH AFRICA’S PROPERTY INDUSTRY

A significant development for property practitioners.

The PPRA has confirmed that, under the current interim court order, a B-BBEE certificate is no longer required for the issuing of a Fidelity Fund Certificate (FFC).

This follows the Gauteng High Court ruling concerning section 50(a)(x) of the Property Practitioners Act.

⚠️ Important: This does not mean that B-BBEE itself has been scrapped. The ruling relates specifically to the B-BBEE certificate requirement for the issuing of an FFC, and the declaration of invalidity still requires confirmation by the Constitutional Court.
