A recent court ruling has clarified an important question for both landlords and tenants: 𝐃𝐨𝐞𝐬 𝐭𝐡𝐞 𝐂𝐨𝐧𝐬𝐮𝐦𝐞𝐫 𝐏𝐫𝐨𝐭𝐞𝐜𝐭𝐢𝐨𝐧 𝐀𝐜𝐭 (𝐂𝐏𝐀) 𝐚𝐜𝐭𝐮𝐚𝐥𝐥𝐲 𝐚𝐩𝐩𝐥𝐲 𝐭𝐨 𝐫𝐞𝐬𝐢𝐝𝐞𝐧𝐭𝐢𝐚𝐥 𝐥𝐞𝐚𝐬𝐞 𝐚𝐠𝐫𝐞𝐞𝐦𝐞𝐧𝐭𝐬?🏡

In the case of Els v Venter, the Supreme Court of Appeal confirmed that the CPA does not automatically apply to all residential leases. It only applies in certain situations where the landlord is renting out property in the “𝐨𝐫𝐝𝐢𝐧𝐚𝐫𝐲 𝐜𝐨𝐮𝐫𝐬𝐞 𝐨𝐟 𝐛𝐮𝐬𝐢𝐧𝐞𝐬𝐬.”

A harsh reminder of how risky property buying can be when proper due diligence is ignored, after a couple discovered a serious hidden defect when a wooden deck collapsed.

The court made it clear that marketing words like “stunning” are just sales language and carry no legal guarantee under a voetstoots clause sale, buyers carry the burden unless they can prove deliberate concealment of defects.

Always, check and verify everything before signing because once the deal is done, hidden problems become your responsibility, not the seller’s.
