Statutory Instrument 76 of 2025 Deeds Registries Regulations 2025 update is out. Some of the basic differences from 2018 Regulations are as follows Material Changes in S.I. 76 of 2025

1. Validation & Digitisation of Title Deeds
• A major shift: all holders of old title deeds must submit them for validation within 24 months (Section 40).
• “Securitised Deeds”: validated deeds will be digitised and re-issued in electronic and securitised formats (Section 41).
• After the transitional period, only securitised deeds will be legally valid.
• This digitisation and modernisation framework was absent in the 2018 regulations.

2. Electronic Services
• New provision (Section 65(3)): electronic services are available online 24/7.
• All business can now be conducted electronically or in person (Section 66). Previously, electronic conduct was not expressly provided for.

3. Obsolete Records
• Registrar is empowered to destroy or dispose of obsolete records after digitisation (Section 42). This authority was not explicit in the 2018 regulations.

4. Fees
• Fees have been revised and increased (Second Schedule). For example:
• Lodging box rental: now US$120/year.
• Certification of documents: US$20 per document.
• Searches: US$1/page.
• Compare to lower fees in 2018.

5. Forms
• Updated prescribed forms for various transactions (First Schedule: DR1–DR9).
• New forms to support validation, digitisation, and securitisation processes.

6. Power of Attorney
• Stricter requirements for general powers of attorney involving immovable property (Section 27).
• Specific rules on attestation, identity proof, and disability exceptions.

7. Identity Requirements
• Enhanced requirements for identity verification (Section 55).
• Includes recognition of foreign passports and new provisions for juristic persons.

8. Mortgage Bonds
• Expanded section detailing consents for dealings with mortgage bonds (Section 47).
• Introduced waivers of preference and specific rules
