Contract & Form 1 Vendor Statement

In South Australia, there are two important documents you’ll come across as either the buyer or seller; the Contract of Sale and the Form 1 Vendor Statement

📄 Contract of Sale
This is the legal agreement between buyer and seller which outlines and contains the terms of the purchase including price, settlement date and any special conditions

📑 Form 1 Vendor Statement
Required under SA legislation, the Form 1 contains all relevant and important information about the property including but not limited to title details, easements, council development approvals and other matters that may affect the land

It’s important to remember that these documents are legally binding and contains critical information that can impact the property purchase – which is why having a conveyancer review the documents before signing is so important

PEXA (Property Exchange Australia)

✔️ PEXA is an Electronic Lodgment Network (ELN) used nationally in Australia for property transactions
✔️ All settlements are completed and lodged via this online system as mandated by the Australian government
✔️ Instead of paper documents and bank cheques, everything is handled digitally and in one place

PEXA provides transparency and clarity when completing a property settlement, coordinating with lending institutions, other conveyancers, and allows for the payment of settlement monies and any other disbursements

What is a Certificate of Title?

We’re back with our Legal Lingo series, and this week, we're focusing on the Certificate of Title. You’ve probably heard of it before, but what does it actually mean for you?

A Certificate of Title is the legal document which shows:
✔️ Who owns a property
✔️ Property details (such as land description)
✔️ Any registered interests against the title (i.e. Mortgages, Easements, Caveats etc.)

In South Australia, Certificate of Titles are now electronic, and no longer physically issued for public circulation

💼 Why does it matter?
Your Certificate of Title is essential in any property transaction, it confirms the legal ownership, and highlights any registered interests someone may have in a property

Whether you’re buying your first home or selling an investment, understanding the certificate of title is crucial to avoiding surprises later on!

The Australian Government has introduced the Australian Government 5% Deposit Scheme, to help eligible first home buyers’ step into the property market sooner, turning your “one day” into “right now”

Under the scheme, you can:
✔️ Purchase with as little as a 5% deposit
✔️ Avoid paying Lenders Mortgage Insurance (LMI)
✔️ Benefit from no income caps, no property price caps or no waiting lists
✔️ Access the scheme through participating lenders across Australia
✔️ Available for new or established homes
✔️ *Eligible single parents or legal guardians may purchase with as little as a 2% deposit

But while Government Schemes make purchasing a property more accessible, the legal process of purchasing remains the same. Having an experienced conveyancer by your side ensures everything is handled correctly and smoothly from the very beginning!

You might come across the word easement when buying or selling property — but what does it mean? 🤔

✅ An easement is a legal right that allows someone else to use part of your land for a specific purpose.

The most common example?
SA Water often has an easement to access underground pipes. Other easements might allow access to a neighbour's driveway or pathway.

💡 Easements don’t usually stop you from enjoying your property — but they do mean you can’t build over them or block access.
