In Real estate time is of the essence
A recent decision of the Ontario Court of Appeal in Correa v. Valstar Homes confirmed that the failure to pay the closing funds on time constituted a breach of contract entitling the Builder to terminate the APS.
The funds were wired at 4:52 pm BUT not received until 5:09 pm.
Those 9 minutes cost the Buyers $113,000 plus costs.
