According to StatsCan....

Interprovincial trade barriers are unnecessarily constraining growth to Canada's economy by an estimated 7%.

While adding between 7.8% - 14.5% to the price of goods and services we purchase.

Dismantling the complex regulatory framework and adhering to the interests of individual provinces are major hurdles to overcome.

But we are MASSIVE. We have the resources...

Doesn't it just make sense to make it easier to trade....within Canada?

Just Leased this beauty in The Beaches!

Representing a Landlord is a lot different than representing a Seller.

Seller doesn't care who buys their property... they want the highest price.

Landlord cares a lot about price AND person.

So sometimes they will add a 'guarantor' to 'guarantee' the lease.
For extra 'protection' they will add them as a 'tenant' instead of a 'guarantor'...

And you'd think you're 100% protected... right?

🚨🚨🚨 WRONG 🚨🚨🚨

In a recent case (2023ONLTB18688), the court made it clear: even if a guarantor is listed as a "tenant" on a lease, they're not automatically considered one. Once the court determines their true role, they can be removed from the lease and the agreement updated.

Why Might This Happen?
Landlords sometimes add 'guarantors' as 'tenants' to:
• Back up rent payments with someone more financially/credit stable.
• Simplify legal recourse in case of default.
• Avoid confusion about role.

What Landlords Need to Know:
• A guarantor only 'guarantees' rent - they don't have tenant rights and you cannot go after them as a tenant.
• Mislabeling them as a tenant doesn't change that, and the court will fix it.
• Proper screening & clear lease terms can help prevent headaches down the road.

Happy Friday & Happy Closing Day! 🥂

When looking at homes, especially when they're a bit older, one of the most important factors to consider (that's not always considered) is the ownership history...

➡️ How many times did the property change hands?
➡️ Was the property ever leased out?
➡️ Were there any insurance claims made on the property?

Luckily for us, the sellers really took care of their home and were an absolute pleasure to work.
