These are most important information to remember by every Landlord and Tenant.

Ontario Landlords: Know the Real Notice Rules (Quick Guide)

Many landlords misunderstand this—so here’s a clear breakdown:

1. Fixed-Term Lease (e.g., 1 year)

* Tenants must give 60 days written notice (Form N9)
* Notice must end on the last day of the lease
* If no notice is given → tenancy automatically becomes month-to-month
* Tenant is not required to move out

2. Month-to-Month – Tenant Rules

* Tenant can leave anytime with 60 days written notice (N9)
* Must end on the last day of a rental period (usually month-end)
* No reason required

3. Month-to-Month – Landlord Rules (Critical)

* Landlords cannot just give 60 days notice to end tenancy
* You must have a legal reason under the RTA

Common examples:

* N12 (Landlord/Family use) → 60 days + 1 month compensation
* N13 (Renovation/Demolition) → 120 days
* N4 (Non-payment) → 14 days (not full termination unless unpaid)

4. Reality

* Tenants can leave with proper notice
* Landlords can only terminate with:
* Valid legal reason
* Proper notice form
* Often an LTB order

Bottom Line

If a fixed lease ends and no notice is given, it does NOT end the tenancy—it continues month-to-month with full tenant protections.

If you’re unsure which notice applies in your situation, verify before acting—mistakes here can delay enforcement significantly.

The seller claimed they didn’t know.
The court still held them responsible.

Why? One clause in the Agreement of Purchase and Sale:
“Warranties that survive closing.”

This clause can protect you even after you get the keys.

• You may still have legal protection after closing
