Roots chase moisture, and foundations create the perfect target: shade, cool soil, and water pooling at the base. Over time, growing roots can wedge into existing cracks and widen them. One of the most common questions during a real estate transaction is: "Does that stay with the house?"
The answer depends on whether the item is considered a chattel or a fixture.
Generally:
✔️ Fixtures are permanently attached to the home and stay with the property.
✔️ Chattels are movable items and go with the seller—unless they're specifically included in the Agreement of Purchase and Sale.
To avoid confusion (and last-minute surprises), always make sure everything that's included or excluded is clearly written into the offer.
