The Ontario government has filed new regulations under the New Home Construction Licensing Act, 2017 (Licensing Act) and the Ontario New Home Warranties Plan Act (Warranties Act) that will introduce a ten-day cooling-off period for buyers of new freehold homes.

The new requirements will take effect January 1, 2027 with new home purchases.

Ten-Day Cooling-Off Period:

Buyers will have a ten-day cooling-off period for purchase agreements for new freehold homes entered into on or after January 1, 2027. This allows buyers to review their agreement and make a more informed purchasing decision. During this period, a buyer may provide written notice to the builder to cancel the purchase agreement and receive their deposit back without penalty.

New Information Sheets and Addenda:

Beginning January 1, 2027, builders of new freehold and condominium homes must also provide buyers with an information sheet and addendum.

For new freehold home purchases, builders must complete the required information sheet and addendum and include them with the purchase agreement delivered to the buyer. The purchase agreement will not be binding on the buyer, and the ten-day cooling-off period will not begin, until builders have met these requirements.

Tarion’s website and the Home Construction Regulatory Authority’s (HCRA) website both provide the new documents, which are intended to give buyers clear and essential information before they finalize their purchase.
