UNTITLED LAND FOR DECADES. CAN YOU FINALLY GET A TITLE?
Your family has possessed the land for decades.
You may have tax declarations, old deeds, inheritance documents, survey plans, and other records showing your family’s connection to the property.
Now you want to finally have the land titled.
Then someone tells you:
“You need to prove possession since 1945.”
THINK AGAIN.
Before treating the titling of untitled land as a simple filing exercise, ask:
• What law applies to the property today?
• What period of possession must actually be established?
• Can possession by parents, grandparents, or other predecessors be relevant?
• Does the land need to be Alienable and Disposable (A&D)?
• How can A&D status be properly established?
• Is a tax declaration enough?
• Is a cadastral survey enough?
• What should be verified from DENR land classification records?
• What role does an approved survey or subdivision plan play?
• What if the relevant land classification records are decades old?
• What if an application was already pending when RA 11573 took effect?
• What documents and factual evidence actually support the application?
These questions matter when dealing with Judicial Confirmation of Imperfect Title, original registration, untitled land, inherited property, land acquisition, land banking, and property development.
If you own, inherited, are buying, or intend to develop untitled land, do not rely only on:
“Our family has possessed it for generations.”
or
“We have tax declarations.”
or
“There is already a survey.”
Investigate the property and its records.

Is a DAR Land Transfer Clearance still required?

YOU’RE BUYING AGRICULTURAL LAND.
The seller has a clean title.
The deed is ready.
Then someone tells you:
“Kailangan pa ng DAR Clearance.”
But wait.
DO YOU STILL NEED IT?
That is a question worth asking in 2026.
What if you are buying private agricultural land?
What if you are transferring agricultural land to another buyer?
What if the property is already titled?
What if you are preparing the documents for registration with the Registry of Deeds?
Is a DAR Land Transfer Clearance still required?
And if someone tells you:
“Hindi puwedeng i-register without DAR Clearance.”
Is that still the rule?
What does DOJ Opinion have to say about the continued requirement for a Land Transfer Clearance from DAR?
What does this mean for agricultural land acquisition, land transfers, title registration, and real estate due diligence?
And perhaps the more important question:
Before you buy or transfer agricultural land, what documents should your lawyer verify first?

Think that agricultural land can be converted so easily?
You think getting a DAR CONVERSION AUTHORITY is so easy, cheap, and inexpensive?

You have money, and you want to invest in land.
You find a large tract of agricultural land because you are thinking about a future subdivision, residential development, commercial project, industrial project, resort, or other non-agricultural use.
Then you are told:
“Residential na ang zoning, sir.”
Before you invest, there are questions worth asking:
Is residential zoning enough?
What if the agricultural land has already been reclassified by the local government?
Is reclassification the same thing as conversion?
Are there limits on how much agricultural land may be reclassified?
What if the property is already covered by CARP?
What if there is already a Notice of Coverage?
What if the agricultural property is a commercial farm?
Can an application for conversion still be filed under these circumstances?
And perhaps the question that should come before the purchase:
What should you verify about the property before you put your money into the transaction?
A recent Supreme Court case involving large agricultural properties, LGU reclassification, CARP coverage, commercial farming, and land conversion raises these questions.

You have money and you want to invest in land.
Large tracts of land are often agricultural lands.
Maybe you're thinking:
"I'll buy the land now, then develop it later."
A subdivision.
A resort.
A commercial complex.
An industrial project.
But be careful. You might lose your investment.
What if the land is classified as agricultural?
What if you bought it specifically because you intend to use it for a non-agricultural purpose?
What if the municipality has already reclassified the property for residential, commercial, or industrial use?
Is reclassification already enough?
What if the property has already been placed under CARP?
What if a Notice of Coverage was issued before you applied for conversion?
