โ€œTOTOO BA NA 50 YEARS LANG ANG CONDO?โ€

Isa ito sa pinakakaraniwang myths sa real estate.

Ayon sa Republic Act No. 4726 (The Condominium Act of the Philippines), walang batas na nagsasabing awtomatikong nawawala ang condominium o ang ownership ng unit pagdating ng 50 taon.

Ang madalas na pinagmumulan ng misunderstanding ay ang Section 13(c) ng batas. Nakasaad dito na ang isang condominium project ay maaari lamang pag-usapan ang dissolution kung lampas na sa 50 taon, obsolete na ang building at hindi na praktikal i-repair o i-modernize, at natugunan ang iba pang legal na requirementsโ€”kabilang ang kinakailangang boto ng mga unit owners.

Sa madaling salita, hindi sapat na 50 years na ang building para mawalan ng halaga o ownership ang condominium.

Bukod dito, mahalagang malaman na hindi lahat ng condominium ay pare-pareho.

๐Ÿข Freehold โ€“ Pagmamay-ari ng developer ang lupa.

๐Ÿข Leasehold โ€“ Ang developer ay umuupa lamang ng lupa sa loob ng isang takdang panahon (hal. 50 o 75 taon), kaya maaaring may limitasyon batay sa lease agreement.

Kaya bago maniwala sa kasabihang โ€œ50 years lang ang condo,โ€ itanong muna: Freehold ba o Leasehold ang project?

Huwag hayaang pigilan ka ng mga maling impormasyon sa pagbuo ng iyong future. Magtanong, magsaliksik, at siguraduhing ang desisyon mo ay nakabatay sa batas at tamang impormasyon, hindi sa hearsay.

Kaya Ang sagot ay: HINDI.
