1. Are you married?
a. if spouse has passed away, do you have death certificate? Continuous marriage?
b. is there a separation or divorce? Has divorce has been filed? What county? Title will a need copy of MDA and final decree!
c. Is spouse available to sign on primary residence?

Comments: closings have been sidelined and even canceled due to sellers being separated but not legally divorced and we were unable to locate the spouse to sign off on marital rights.

2. Do you have a loan payoff?
a. Do you know your balance?
b. Are you current on your payments?
c. Did you receive down payment assistance?
e. Have you ever deferred payments?
f. Are you paying on improvements to your home? UCC with gas departments, windows, air purifiers. All these need to be considered in net sheet.

Comments: we have had a lot of sellers that don’t understand the THDA 2nd Mortgages get paid at the sale of property. Also, the deferred FHA payment are recorded as 2nd mortgages and sometimes 3rd and 4th.

3. When you purchased did you get a Warranty Deed and Title Insurance?
a. Do you have a copy of your title insurance?
b. Were any issues brought up at closing?
c. Did you inherit the house? Was it through probate court?
e. Did you purchase the house through foreclosure or tax sale?

Comments: we are seeing a lot of properties that have passed through Heirship or by QCD and the proper documents were not obtained for insurability. Missing heir signatures have killed deals.

Also, not all are liens wiped out by foreclosure. And Tax Sale insurability is hard.

4. If this is a mobile home, do you have title or proof of DETITLE from State of TN?

Comments: GET THE VIN or HUD PLATE AND CALL US!

5. Is a POA being used?
a. Do you have original?
b. Has it been recorded?
c. Why is it being used?

Comments: we have to review the language, signature and recording to make sure it meets title insurance requirements. The original must be recorded. We prefer that to be done prior to closing so we don’t keep original POAS.
