Problem 1: The title is not in your name yet.
If the deceased owner's estate has not been properly probated and the title transferred into your name, you cannot legally sell the property. This is one of the most common delays in inherited property sales in Florida. It can take weeks or months to resolve depending on whether a will exists, whether it was probated, and how many heirs are involved. Start this process before you list, not after you accept an offer.

Problem 2: Unknown/Hidden liens: Old contractor debts, unpaid HOA dues, a reverse mortgage the family did not know about, or a judgment against the deceased can all attach to the property and surface during the title search. These must be resolved before closing can happen.

Problem 3: FIRPTA for foreign heirs. If any heir is a foreign person, the buyer may be required to withhold up to 15% of the sales price under federal law. This needs to be identified before the contract is signed, not at the closing table.

Selling an inherited property in Florida is one of the most emotionally and legally complex real estate transactions there is. And most people walk into it without knowing what to expect.

Title issues, probate delays, unknown liens, and federal withholding requirements can all surface mid-transaction and derail a sale that everyone thought was straightforward.
