🏡 “I saved on the agent fee!”

But… did you really save? 🤔

There’s absolutely nothing wrong with wanting to protect the money you worked hard to earn. I want to save money too.

But when buying or selling a home, there’s one question I want you to think about:

“Did I reduce a cost…
or did I reduce the protection I needed?”

Buying a home isn’t like buying something from a store and saying, “I don’t like it anymore, I’ll return it.” 😅

It’s a major financial and life decision.

🤝 “The seller’s agent is really nice. I’ll just work directly with them…”

They may absolutely be a nice person.

They may answer your questions, show you the property, and help move the transaction forward.

But there’s an important difference between:

“Helping you”
and
“Representing your best interests.”

If someone is working as the Seller’s Agent, their client is the seller.

They still have obligations to deal honestly and fairly with buyers and to disclose certain known material facts as required by law.

But that does not automatically mean they are representing you, the buyer.

For example, imagine walking through a house and saying:

“I love this house. I really want it. If I need to, I can go higher.”

To you, that may simply be an honest expression of excitement.

From a negotiation standpoint, though… you may have just shown all your cards before negotiations even started. 😅

So instead of asking only:

“Is this agent nice?”

Also ask:

“Who is this agent representing in this transaction?”

In New York, Dual Agency may also exist, where one agent or brokerage represents both sides with informed written consent.

But that is different from having someone whose loyalty and representation are dedicated specifically to your side.

🪧 “What if I’m the seller? Can’t I just sell my house myself?”

Of course you can choose to sell your own property.

But “selling the house” and “selling it at a strong price, with favorable terms and manageable risk” are not necessarily the same thing.

Putting a “For Sale” sign in front of the house doesn’t always mean the work is finished.

Sometimes… that’s when the real work begins. 😄

What price should you start at?

How should the property be marketed so it reaches the right buyers?

Is the buyer who says, “I’m interested,” actually financially capable of closing?

If you receive two offers, do you automatically take the highest price?

Or do you also compare financing, contingencies, timelines, down payment, qualifications, and other terms?

And who is going to review, coordinate, organize, and negotiate all of those details?

As a seller, the question shouldn’t only be:

“How much commission can I save?”

It should also be:

“After all expenses, how much will I actually walk away with?
Under what terms?
And how much risk am I taking?”

💸 What if you save $2,000… but lose $10,000 somewhere else?

Let’s use a simple example.

Imagine you save $2,000 in professional fees.

But because something was missed during due diligence, repair evaluation, pricing, or negotiation, you end up spending or losing another $10,000.

Did you really save $2,000?

Or did you end up $8,000 behind?

Those numbers are simply an example to make the point.

They are not a standard agent fee, and I am not saying that having a Realtor guarantees there will never be problems—or that someone without one will automatically lose money.

The point is:

Don’t measure only the fee you saved.
Measure the total cost and risk of the decision.

Real estate commissions are not one legally fixed rate. They are negotiable.

That’s why it is important to clearly understand what services are included, who is paying what, and what responsibilities each party has under the agreement.

🔎 And simply having a Realtor isn’t enough either.

Yes—I’m saying that as a Realtor myself.

The more important question isn’t:

“Do I have an agent?”

It’s:

“What is my agent actually doing for me?”

An agent representing you has professional responsibilities that may include loyalty to the client, protecting confidential information, disclosing material information, exercising reasonable care, and advocating for the client’s interests within the scope of the agency relationship.

Those responsibilities shouldn’t exist simply because someone is “nice.”

In my view, a good Realtor is not someone who only says:

“The house is beautiful. You should buy it.”

A good Realtor should also be willing to say:

“Yes, it’s beautiful—but let’s check this issue first.”

And not simply:

“This is the highest offer. Take it.”

But instead:

“The price looks strong, but are these terms actually good for you?”

Rather than waiting until a problem appears and saying, “I didn’t know,” I believe in choosing a proactive agent who says:

“There may be a risk here. Let’s investigate it before it becomes a bigger problem.”

At the same time, Realtors do not replace inspectors, attorneys, lenders, engineers, accountants, or other professionals.

When something falls outside an agent’s area of expertise, part of doing the job responsibly is knowing when to recommend that the client seek advice from the appropriate professional.

❤️ Behind every home, there is more than money.

For one buyer, the down payment may represent nights spent working overtime.

For another, it may represent years of saying no to things they wanted so they could save.

For someone else, it may represent one simple dream:

“I want to give my family a good place to live.”

For a seller, a home may be much more than bricks and walls.

It may be the place where their children grew up.

The place where family memories were created.

Or the asset they’re counting on to begin the next chapter of their life.

So yes—

Protect your money.
Be smart about your expenses.

But don’t overlook the protection you may need simply to reduce a fee.

Ask:

“How much will this cost me?”

But also ask:

“What am I receiving in return?
How will my interests be protected?
And who is actually standing on my side?” 🏡❤️

👉 Asking Price —
👉 Contract Price —
👉 Appraised Value —

Home Inspection — “ဒီအိမ်ရဲ့ စနစ်တွေနဲ့ အခြေအနေမှာ ဘာပြဿနာတွေရှိလဲ?”

Appraisal gap က—

$850,000 − $800,000 = $50,000

① Appraisal Contingency

🏡 New York

🏡 “Your $850,000 offer is accepted… but the appraisal comes back at $800,000. Now what?” 🤔

Does the buyer bring another $50,000?
Does the seller have to lower the price?
Can either side walk away?

Before that situation happens, buyers and sellers should understand what an appraisal does—and what it does NOT do.

🔍 1. What is an appraisal, and why does it matter?

An appraisal is an independent, evidence-supported opinion of a property’s market value as of a particular date. It is not a guarantee of its future selling price.

Keep these three numbers separate:

👉 Asking price: What the seller requests.
👉 Contract price: What buyer and seller agree to.
👉 Appraised value: The supported valuation.

They do not always match.

When you use a mortgage, the home serves as collateral. The lender therefore evaluates both your ability to repay and the property supporting the loan.

👤 2. Who performs and orders the appraisal?

When required for a mortgage, the lender generally selects a state-licensed or certified appraiser, directly or through an appraisal management company.

The appraiser’s job is to produce a supported valuation—not the number a buyer, seller, or agent wants.

A private appraisal obtained by the seller does not automatically replace the buyer’s lender-ordered appraisal.

🗓️ 3. When does it happen, how long does it take, and who pays?

It generally happens during the mortgage process after a purchase agreement and before closing. The buyer typically pays.

Freddie Mac notes that the report may take approximately one to two weeks after the property visit, sometimes longer. That is not a guaranteed order-to-completion timeline.

Fees vary with the property, location, and assignment. Ask your lender for the current fee and expected timing rather than assuming one price applies to every New York home.

📊 4. How is the value determined?

The appraiser considers location, size, layout, condition, lot characteristics, and comparable sales—often called “comps.”

The analysis accounts for meaningful differences between properties. It is not simply an average of nearby asking prices. Closed sales and their comparability matter.

Depending on the property, the appraiser may also consider replacement cost with depreciation and land value, or an income-based approach for rental property.

Does the appraiser always visit personally? No. Eligible loans may permit a desktop appraisal using reliable property information, photographs, and floor plans. That is still an appraisal, not an appraisal waiver.

🛠️ 5. Is an appraisal the same as an inspection?

Appraisal: “What is the property’s supported market value?”

Inspection: “What condition are the home and its systems in?”

An appraisal considers condition and may identify repairs required for the loan. But a satisfactory value does not mean the home has no hidden defects. An appraisal does not replace a home inspection.

💰 6. What happens financially when the appraisal is low?

Here is a distinction worth saving: the appraisal gap is not always the same as the additional cash needed beyond your original plan.

Assume the lender’s approved loan remains capped at 80% of the lower of the purchase price or appraised value—a common conventional purchase-loan calculation. This is an example, not a universal 20% down-payment requirement.

Original plan:

Purchase price: $850,000
Buyer contribution: $170,000
Mortgage: $680,000

Actual appraisal: $800,000

Appraisal gap:

$850,000 − $800,000 = $50,000

With the price unchanged and the same 80% financing limit:

Revised mortgage: $800,000 × 80% = $640,000
Buyer’s total contribution toward the price: $850,000 − $640,000 = $210,000
Additional contribution beyond the original plan: $210,000 − $170,000 = $40,000

💡 The gap is $50,000, but this buyer needs $40,000 more than originally planned.

Another way to see it: 20% of the appraised value—$160,000—plus the $50,000 gap equals $210,000.

Closing costs, prepaids, and required reserves are excluded. A different approved loan structure or negotiated price changes the calculation.

Any contract deposit credited toward the purchase price is part of that total contribution, not an additional amount to count twice.

🤝 7. What options does the buyer have?

Negotiate the price. The seller may agree to a reduction, but a low appraisal does not automatically require one.

Review financing with the lender. Additional verified funds or another approved financing structure may help, depending on eligibility.

Request a reconsideration of value when supported by evidence. Incorrect property information, overlooked features, or more appropriate comparable sales can be brought to the lender’s attention. An ROV is not a promise of a higher value or a way to demand the desired loan amount.

Consider cancellation only under an applicable contractual right. Your attorney should review the wording, deadlines, and notice requirements. Do not assume your deposit is automatically refundable.

📝 8. Are an appraisal contingency and an appraisal waiver the same?

No. Separate these three concepts:

① Appraisal contingency: A contract provision that defines the buyer’s rights relating to the appraisal.

② Buyer waiving that contingency: Giving up specified contractual protection. This does not tell the lender to skip its appraisal. A financing contingency is not automatically equivalent protection.

③ Lender appraisal waiver: An eligible loan may qualify for a lender-approved process that does not require a new appraisal. Fannie Mae calls its option “Value Acceptance.” This does not automatically rewrite the purchase contract.

A cash buyer has no mortgage lender’s appraisal requirement but may still choose an independent appraisal. Paying cash does not eliminate the possibility of overpaying.

📈 9. What happens when the appraisal is higher?

Imagine a purchase price of $800,000 and an appraisal of $825,000.

That difference is not a $25,000 cash refund at closing. Standard conventional purchase financing generally uses the lower of price or appraised value for the loan-to-value calculation.

A higher appraisal also does not guarantee a future resale price or final mortgage approval. The lender still must complete its other reviews.

📄 10. Can the buyer receive the report?

For covered first-lien mortgage applications, borrowers are entitled to free copies of appraisals and written valuations. Generally, delivery must be prompt after completion and at least three business days before closing, unless an allowable timing waiver applies.

A free copy does not mean the appraisal service itself is free.

Read more than the final number. Review property details, size, comparable sales, condition, and any required repairs. Raise supported concerns through your lender.

🗽 11. What should New York buyers be especially careful about?

A finished basement may contribute value, but in single-family appraisals it is generally reported separately from above-grade living area. Do not assume every finished square foot is treated identically.

An appraisal also does not legalize a conversion, basement apartment, or additional dwelling unit.

In NYC, verify lawful use through the Certificate of Occupancy or other applicable Department of Buildings records. Some buildings have exceptions to CO requirements, so involve your attorney and appropriate professionals.

🏠 12. What should sellers and buyers prepare?

Sellers: Make the property accessible, organize improvement and maintenance records, and provide accurate information. Do not pressure the appraiser for a particular number.

Spending $50,000 on renovations does not automatically increase appraised value by $50,000. Market-supported value—not simply the owner’s cost—matters.

Buyers: Before making an offer, answer three questions:

✅ How much additional cash could I realistically contribute?
✅ What does my contract protect, and what deadlines apply?
✅ Would I still have money for repairs and emergencies afterward?

Sellers should also compare financing, appraisal terms, and the buyer’s demonstrated ability to address a shortfall—not just the offer price. A higher offer does not, by itself, resolve appraisal uncertainty.

🔑 Remember:

The purchase price is the agreement.
The appraisal is a supported opinion of value.
The financing and contract determine what happens when those numbers differ.

The figures above are illustrative. Confirm your specific financing and contractual rights with your lender and New York real estate attorney.

No siempre coinciden.
