Let's take a closer look at this. Section 8, like all other vouchers, is a source of income and as such is a protected class in New York State. That alone does not guarantee a prospective tenant the apartment unless the voucher covers the entire rent. If it does not, my understanding is that a landlord may apply their income requirement, whatever it might be, as long as it is the same for every tenant, to the portion of the rent not covered by the voucher.

This in no way means that a landlord must lower their rent so a voucher can fully cover it. So, Manhattan apartments may still be at a rent that is too high for some, and that is true for everyone who subsequently turn their search elsewhere, to the outer boroughs or suburbs, where they find rents they can afford, and quite possibly totally covered by the voucher. I know a landlord in lower Westchester County, with about a dozen or so buildings, who prefers voucher tenants because they never have to worry about rent being paid.

Those who know me know that I have been anti-StreetEasy for years because of their obviously deceptive advertising techniques. I agree with NYRAC that NYS Dept of State did not go far enough in its ruling, while recognizing that this is a step in the right direction.

The real concern is that the process to get here took 3+ years, and not Zillow companies know that if they want to push the limits of New York Real Estate Law that they can essentially have their way for 3+ years. 75%+ of all Zillow Companies total revenue is generated from agent advertising, some not as obvious to the public as many, like me, feel it should be.

New York has adopted stricter rules for online real estate advertisements, years after the real estate industry went up in arms over StreetEasy’s Premier Agent program.
