Mortgage: It doesn’t disappear. Payments still need to be made, or the home could eventually face foreclosure.
No Will: State law determines who inherits the home, and the estate may need to go through the court process.
Will: Your wishes determine who you want to inherit the home, but the estate may still need to go through probate.
Living Trust: If the home is properly placed in a living trust, it can generally pass to your beneficiaries without going through probate.
