A small detail can make a big difference in a notarization.

The National Notary Association recently addressed a question from an Illinois Notary about whether they need to include their middle name when signing if it appears on their Notary commission.

The answer: Yes, in Illinois, the Notary must sign as commissioned. It’s a good reminder that details like names, signatures, certificates, and commission requirements deserve attention. Small inconsistencies can create questions or delays when completing documents.

Of course, Notary requirements can vary by state, so Notaries should always refer to their own state’s laws and guidelines when they’re unsure.

Does a notarization always require witnesses to be present?

It’s an important question, and it can get especially tricky when a document includes both notarized and witness-only signatures.

According to the National Notary Association, the signer and witnesses should all be present at the time of notarization, when the witnesses are there to observe the signer’s signature. The NNA also emphasizes that notarial requirements can vary by state, so notaries should always refer to the applicable state laws when they’re unsure.
