Buying a home with someone else? How you take title can affect what happens to the property during ownership and what happens if one owner passes away.
Tenants in Common (TIC):
Each owner has a separate ownership interest in the property. Those interests can be equal or unequal, and an owner can generally transfer their share independently. When one owner dies, their interest typically passes according to their estate plan or applicable state law instead of automatically to the other owner.
Tenants by the Entirety (TBE):
This form of ownership is generally available only to married couples in states that recognize it. The spouses typically own the property together as a single legal unit, and when one spouse dies, the surviving spouse generally receives the property automatically through survivorship.
