CFPB Leadership Shift: Impact on Compliance

The Consumer Financial Protection Bureau (CFPB) is undergoing another leadership transition, with Russell Vought now serving as acting director following Scott Bessent's brief tenure. Vought has continued the operational pause initiated by Bessent.

Despite this pause, legal and compliance experts indicate that federal regulations such as the Real Estate Settlement Procedures Act (RESPA) and the Unfair, Deceptive, or Abusive Acts and Practices (UDAAP) rules remain in effect. Industry professionals emphasize that businesses should continue to adhere to these regulations, as enforcement responsibilities can still be taken up by state attorneys general and private litigants.

Historically, similar funding pauses have occurred at the CFPB without disrupting enforcement. Experts also note that while the bureau's litigation activities may slow temporarily, state-level enforcement efforts may increase to fill any gaps.

For businesses operating under RESPA and UDAAP guidelines, the primary advice remains to maintain compliance. While the CFPB's activities are currently limited, regulatory oversight continues through other channels, and enforcement actions could resume once operations stabilize.

A member of our community has suffered a tragic loss in her life and had spent the past few months neglecting her business to spend the last precious time with her loved one. It's so hard to pull yourself back together and go back to work after a tragic loss, but when you ARE your business, your suffering becomes far deeper.
