What agents must check in an offer before presenting to sellers 🏠

An offer to purchase is not simply a document recording the price a buyer is willing to pay. Once accepted and properly concluded, it can become a legally binding agreement with significant consequences for both parties. 📜 This is why agents have a responsibility to ensure that an offer is properly completed, clearly understood and accurately presented.

The first thing to check is that the buyers and sellers are correctly identified, the property description is accurate and the purchase price and payment arrangements are clearly stated. Next, examine the conditions attached to the offer. Is it subject to bond approval? Does the buyer need to sell another property first? Are the timelines realistic? Who is responsible for obtaining the necessary certificates, and what happens if a condition is not fulfilled?🏘️

While buyers naturally gravitate towards homes that look picture-perfect in listing photos, the freshly renovated home isn't always the smartest purchase. An outdated kitchen, questionable paint colour or old bathroom can always be upgraded but a noisy road, poor access, or the wrong neighbourhood can’t.

when it comes to property, the oldest rule in the book still remains strong: location trumps everything, even renovations.

Making property disclosure easy for sellers and landlords 🏡

When the Property Practitioners Act 22 of 2019 came into effect on 1 February 2022, it changed the way every property transaction in South Africa is supposed to start. Section 67 of the Act is clear. A property practitioner may not accept a mandate from a seller or landlord unless the owner has provided a fully completed and signed Mandatory Disclosure Form, also called the Immovable Property Condition Report, beforehand. The form must then be attached to any agreement for sale or lease. 🏘️

this applies to both sale and rental transactions. It is not optional. And for agents who treat it as a formality to get out of the way after the fact, the legal consequences are real.

What the Form Actually Requires

The Mandatory Disclosure Form requires the owner to declare the condition of the property honestly, covering defects that are visible and easily identifiable, defects that may only become apparent later, and anything that has been deliberately concealed in the past. The owner certifies that the information is true to the best of their knowledge at the date of signature.
