AGENTS & SELLERS — A SALE MAY BE COMPLETE, BUT A COMMISSION DISPUTE CAN CONTINUE.
An agent recently shared her experience: she marketed a property under a sole mandate and spent time discussing it with an interested buyer living approximately 800 km away. After the mandate expired, she reports that the seller sold directly to that buyer.
According to her post, almost a year after the sale, the commission claim remained unresolved despite attorney correspondence.
It is a reminder of how unpaid work, unexpected claims and legal expenses can overshadow a property transaction.
AGENTS: Keep dated records of enquiries, telephone discussions, introductions and viewings. Give sellers appropriate written feedback. If you never told the seller about a prospective buyer, they may genuinely not know that you have already assisted that person.
SELLERS: If a buyer approaches you directly, ask whether an agent has already assisted them with your property. Inform your agent and check your mandate obligations before proceeding.
An expired mandate does not automatically settle whether commission is payable. Equally, an enquiry alone does not automatically establish a claim. The agreement, the agent’s involvement and the evidence matter.
Do not leave everyone relying on “he said, she said.” Clear communication and written records protect professional relationships and help prevent disputes.
