Property Market Terminology | Occupation Date vs Transfer Date: What’s the Difference?

These two dates are often confused, but they have very different meanings when buying or selling property.

🔑𝐎𝐜𝐜𝐮𝐩𝐚𝐭𝐢𝐨𝐧 𝐃𝐚𝐭𝐞 – The day the buyer is entitled to move into the property or the seller must vacate. This is when the buyer takes physical occupation and receives the keys.

📜𝐓𝐫𝐚𝐧𝐬𝐟𝐞𝐫 𝐃𝐚𝐭𝐞 – The day the property is legally registered in the buyer’s name at the Deeds Office. This is when legal ownership officially passes to the buyer.

𝐓𝐡𝐞 𝐭𝐰𝐨 𝐝𝐚𝐭𝐞𝐬 𝐝𝐨 𝐧𝐨𝐭 𝐚𝐥𝐰𝐚𝐲𝐬 𝐟𝐚𝐥𝐥 𝐨𝐧 𝐭𝐡𝐞 𝐬𝐚𝐦𝐞 𝐝𝐚𝐲.

If occupation takes place before transfer, the buyer is occupying a property that is still legally owned by the seller. In this situation, the buyer will generally be required to pay occupational rent to the seller, as agreed in the Offer to Purchase.

For example: If you move into your new home before transfer takes place, you may need to pay the seller occupational rent until the property is officially registered in your name.
