Sectional Title - Exclusive Use Area

Think you own your parking bay or garden? Not necessarily.

In many schemes, parking bays and gardens are exclusive use areas. This means they remain part of the common property, but a specific owner has the exclusive right to use them. These rights may be registered under section 27 of the Sectional Titles Act, or created by the scheme’s rules under section 27A.

You cannot simply build, enclose, extend or alter an exclusive use area as if it belongs to you. The scheme’s rules, the STSMA Regulations and, in some cases, owner approval may apply.

The body corporate remains responsible for maintaining common property, but the owner who holds the exclusive use right must at least keep the area clean and neat. The body corporate may also recover maintenance costs linked to that exclusive use area from the holder.
