The latest FNB Property Barometer points to a gradual cooling in South Africa's residential property market, with house price growth easing as higher borrowing costs continue to weigh on demand.

Evicting unlawful occupiers could soon become a less complicated process for property owners, with government currently proposing the most significant overhaul of eviction laws in decades.

The changes aim to make the eviction process clearer, faster and more consistent, but they stop short of tipping the balance in favour of property owners, with constitutional protections for unlawful occupiers remaining in place.

The proposed Prevention of Illegal Eviction from and Unlawful Occupation of Land Amendment Bill will update the current act. It will achieve this by giving courts clearer guidelines for making rulings on eviction cases, introducing tougher penalties for organised land invasions and creating a more structured approach to alternative accommodation.

The amended Act also aims to reduce delays in eviction cases. It also introduces the possibility of a fast-tracked eviction process for landlords who can prove that they are suffering undue financial hardship.

The Bill also proposes significantly tougher penalties for organised land invasions. Anyone who incites, arranges or organises unlawful occupations could face up to five years' imprisonment (up from the current maximum of two years), even if they did not receive any financial benefit.
