💚🤍Warning: Don’t Let Rogue Tenants Outsmart You With AI

Tech experts have warned that fraudsters are using Artificial Intelligence to create fake documents. Here’s what landlords need to know.

The news is currently awash with stories about the marvels of Artificial Intelligence (AI).

Unfortunately, however, there is a downside to this technological tsunami – one that will concern landlords.

Some of the earliest adopters of AI are fraudsters who are utilising its capabilities for illegitimate purposes.

A recent article by Forbes raised the alarm. It cited cybersecurity experts who say criminals are using ChatGPT’s new image generation tools to create convincing fake passports, driver’s licences and documents.

These claims were put to the test by Polish engineer and researcher Borys Musielak.

He discovered, as he explained in a LinkedIn post, that he could create a credible replica of his passport, which would pass many security checks.

And it only took him five minutes.

💚🤍Implications for landlords

Landlords have always needed robust reference and credit check processes.

But now, perhaps more than ever, there’s no room for complacency.

In our experience, when things go wrong, it’s not because landlords have failed to carry out any tenant screening checks at all.

It’s that they didn’t scrutinise documents and references as rigorously as they should.

Sometimes, it’s because someone they know - maybe a mate or colleague - has vouched for a potential tenant.

Other times, there’s a sense that the clock is ticking. With an empty property and bills to pay, they want to get a tenant in quickly, so they don’t ask enough questions.

💚🤍Tips for landlords

While ID checks are critical (and, for the reasons mentioned above, they need to be thorough), they’re just one piece of the puzzle.

It’s important that landlords also look closely at a tenant’s credit history (including their track record on paying bills on time, and if they have any county court judgements).

You should also request references from previous landlords and the tenant’s current employer.

Never take these at face value. Follow up with your own checks by, for example, contacting the employer yourself to ensure everything is above board.

While technology has its place, there’s no substitute (at least not yet) for human interaction and curiosity.

Take advantage of the summer weather and get ahead with maintenance on your rental property.

Summer isn’t just the perfect time for lazy picnics in the park and trips to the seaside.

The long, sunny days also make it an ideal opportunity for landlords to undertake important maintenance and safety checks.

So don’t wait until winter to discover that there’s an issue with your roof, boiler or gutters.

Be proactive and follow this checklist.

💚Roof and gutter inspection

Inspect the roof for problems such as broken tiles or leaks, and clear the gutters to prevent blockages.

If any issues are detected, rectify them early, as small defects can quickly escalate and cause costly damage.

🤍Garden review

If neglected, plants, grass and weeds can run riot in summer.

Tenants are typically responsible for tasks such as mowing and weeding to prevent this from occurring.

If this is the case at your rental (it should be detailed in the tenancy agreement), remind tenants of their responsibilities.

Also, ensure that fences and sheds are structurally sound and sturdy enough to withstand heavy gusts.

💚Boiler check

Summer is a great time to get the boiler checked by a Gas Safe registered engineer (it’s a legal requirement for landlords to do this annually).

You should find it easier to get in touch with a qualified engineer, as they receive fewer emergency callouts during the warmer months.

Don’t forget also to bleed the radiators; this will mean the heating works more efficiently in winter.

🤍Retrofitting

If you’ve been thinking about making changes at your buy-to-let to improve its energy performance rating, act now.

Whether you plan to install solar panels or a heat pump, or replace rickety windows, you can expect fewer delays to work in summer.

💚Look out for pests

When conducting your next periodic inspection, keep your eyes peeled for signs of pest infestations.

Summer is breeding season for lots of creepy critters, including bedbugs.

Other bugs to look out for include bird mites (if you’ve had a problem with birds nesting in your roof, be vigilant for these bloodsuckers) and wasps.

When you’re selling your property, material information is one of the many things you need to know about. Here’s an explanation of what material information is and how important new rules will affect you.

💚What is material information in a property sale?

Material information is basic information about a house or flat that prospective buyers need to know.

Material information includes, among other things: the price, number and type of rooms, utility information, Council Tax band, any flood risks, details of parking and any rights or restrictions that the property has.

If your property is leasehold, then material information includes things like the length of the lease, ground rent and any service charges payable.

🤍Why is material information important?

Material information gives prospective buyers the facts they need to make a sound decision on whether to buy or not.

Having all the material information available when your home goes on the market can help attract the right buyer and assist the sale to go through more smoothly.

If the material information is incomplete or inaccurate, it could cause problems at the conveyancing stage, or possibly cause the sale to fall through.

💚The new material information rules

For several years now, National Trading Standards has provided useful guidance on what material information should be provided when selling property.

But just recently, this guidance has been withdrawn.

This is because a new law has just come into force – The Digital Markets, Competition and Consumers Act 2024.

This new law does not specify what material information must be provided to buyers. However, it prohibits unfair trading, including omitting relevant material information.

🤍What sellers need to do

A big advantage of using an estate agent who’s up to speed with the rules is that you don’t need to worry about what’s involved.

Your estate agent will collect the necessary information and make it available to prospective buyers when they need it.

All you need to do is be ready to answer any questions your agent has to help them do this. (Always be open and honest with your responses. Making misleading material information claims can have serious legal consequences.)
