When was the last time your compliance policies and procedures were reviewed?

Regulations change. Programs evolve. Portfolios grow. Technology changes how work is completed, and responsibilities shift between site teams, regional leadership, and compliance departments.

However, the written procedures do not always change with them.

THURSDAY TIDBIT: A policy, a procedure, and a program requirement are not the same thing—but they must work together.

Program regulations, agency guidance, governing documents, and other applicable requirements establish what an owner or management agent must do.

The organization’s policy explains the standard it has adopted to meet those requirements.

The procedure explains how its team will carry out that policy consistently.

For example, a housing program may require annual recertifications to be completed by a specific effective date. The organization may adopt a policy requiring the process to begin 120 days in advance. Its procedure would then identify when notices are issued, who collects the documentation, who reviews the file, and how resident nonresponse or other delays are handled.

Another program requirement may establish which documents are acceptable for verifying income or eligibility. The organization’s policy may require an additional quality-control review before approval. The procedure would explain who completes that review, what must be checked, and how deficiencies are returned for correction.

Owners and management agents may structure their internal processes differently. One may require approval from a compliance department, while another gives trained site leadership approval authority.

Those internal differences may be acceptable as long as the organization’s policies and procedures:

• Comply with the applicable requirements
• Do not remove required protections or documentation
• Are applied consistently
• Do not conflict with Fair Housing requirements
• Clearly identify responsibilities and approval authority

The regulations establish the guardrails. The policy establishes the organization’s standard. The procedure explains how the team stays within those guardrails.
