Tip of the day: when it comes to legal matters, like the sale of real estate, only a certified death certificate will work, not a copy. Certified means that it has some type of stamp or seal.

Back in the day, if someone cosigned a loan for your house, they were put on as a co-owner of the home. Many people don't realize this and think that they own the home outright. Then later, when they try to sell it, they realize someone owns the house with them.

This just happened to a client of mine. That cosigner, if alive, has to sign the paperwork to sell the house. If deceased, a certified death certificate has to be presented to the title company.

Another client from a few years back realized that her parents' home was half owned by some friends of theirs who had cosigned. But those friends were deceased and ownership passed to their children because of the type of deed they used. Everything turned out fine, but the paperwork pile was huge! Lol

How do you know if you own your house by yourself? Check the most recent deed that's on file with your city or county clerk. Or if you're about to list your home, your real estate agent can ask the title company to do a preliminary title search. That's how my client found out the cosigner was on the deed.
