Listing agreement! The contract that allows a broker to represent a seller in the sale of their home. The lender's policy covers your mortgage holder against title related issue. It's typically mandatory to approve your loan funding. But it ONLY protects the lender, so get your own title insurance as well!

Legal Description is this week's term. It's an unique property identifier that describes with complete accuracy the boundaries, location and size of a specific property. It's not an address and each parcel of land has one. It can be written out as metes and bounds or lot and block descriptions.

Congratulations to my wonderful buyer on the purchase of her new home! Respecting her wishes for privacy, the post does not include her name, photo or address, but her accomplishment still deserves a mention. We had been working together since last summer, looking for her perfect waterfront retreat while she navigated closing an important chapter in her life. Once she saw this home, it was impossible to deny that it was hers. We had a smooth transaction from start to finish and this week the newest chapter of her journey began. I couldn't be happier or more excited for her. Here's to many quiet and slow mornings out on the deck enjoying the beautiful view!

First term as we go down the alphabet into L is "latent defects". They are the issues that are hidden and can't be found through reasonable inspection. Things hidden behind walls, for example, are latent defects. Disclosure laws vary by state, but if sellers have knowledge of them, at a minimum they have to tell the truth if asked. They also can't conceal latent defects.

Junior liens to close our J terms. It's very simple: a junior lien is lien placed on a property that already has another one on it. So a HELOC is a junior lien under a mortgage, which is a senior lien. Junior liens get paid off after senior liens.

Continuing with our J terms. Do you know what a judgment lien is? When someone wins a lawsuit against someone else, a court can order that the money judgment be recorded against the defendant's personal or real property. Real estate is real property and if there's enough equity in it, creditors can record a judgment lien against it.
