New section 8 rules

🚨 Mandatory possession for rent arrears now requires 3 months' unpaid rent

Many landlords are still unaware of one of the most significant changes introduced under the Renters' Rights Act.

Previously, landlords could rely on mandatory Ground 8 possession proceedings when a tenant had accrued at least 2 months' rent arrears.

Under the new rules:

✅ The threshold has increased to 3 months' unpaid rent
✅ The arrears must remain at that level when the case reaches court
✅ The notice period has increased to 1 month (4 weeks)

For landlords, this means a longer period before possession proceedings can begin and potentially greater financial exposure when rent payments stop.

The key takeaway? Early intervention is more important than ever. Monitoring rent payments, maintaining communication with tenants, and seeking professional advice at the first sign of arrears can help minimise losses and protect your investment.

While many regulations are designed to improve standards and protect tenants, someone ultimately has to pay for compliance.

In most cases, those increased costs don't disappear - they find their way into higher rents.
