Great information

🧱 Most people who set up a trust complete step one — signing the document — and stop. The trust never gets funded. The home stays titled in their name. The accounts stay in their name. And at death, everything goes through probate anyway.

Funding means retitling. Your home deed needs to reflect the trust as owner. Your brokerage accounts need to be retitled or name the trust as beneficiary. Anything that stays in your individual name at death is subject to probate regardless of what the trust document says.

The companion documents matter too. A pour-over will catches anything that did not make it into the trust. A durable power of attorney covers financial decisions if you are incapacitated before death. A healthcare directive covers medical decisions. These are not optional add-ons — they are what makes the full plan function.

The trust itself is revocable. You can change the beneficiaries, the trustee, or the terms at any time while you are alive and competent. It does not affect your taxes. It does not remove your control. It just changes what happens when you are no longer able to manage things yourself.
