Big change in housing: HUD has rescinded its 2020 guidance regarding Emotional Support Animals (ESAs) and is moving toward a clearer distinction between emotional support animals and trained service animals.

And honestly, I believe clarity is a good thing.

First and foremost: people with disabilities who rely on trained service animals deserve every protection available. A true service animal is not simply a pet — it is an animal trained to perform a specific task that helps a person with a disability live their life.

The challenge over the last several years has been the law of unintended consequences.

Because emotional support animals received broad accommodation treatment, the system also created opportunities for abuse. In property management, we saw situations where some individuals used ESA documentation not because they had a genuine disability-related need, but simply as a way to bypass pet policies, pet fees, or deposits.

And unfortunately, when any system gets abused, the people who are hurt the most are often the people the system was originally designed to protect.

It creates skepticism. It creates extra scrutiny. And it makes life harder for individuals with legitimate disabilities who truly depend on their service animals.

Responsible pet owners are not the problem. Emotional support animals can absolutely provide comfort and companionship. Many of us love our animals and understand the positive impact they have on our lives.

But there is a difference between a beloved companion animal and a trained service animal performing a disability-related task.

Good housing policy should protect residents with disabilities, protect responsible pet owners, and also allow property owners to maintain fair and reasonable standards.

In the end, this change is about restoring that balance.
